You: The Client
Artwork: The portrait or artwork, including mock ups, drafts and prints produced by the Artist whether shared in hard copy, photograph or digitally.
Copyright
I retain full copyright on all Artwork that I produce. This means that I can create prints, calendars or any other products through any medium using the image of the Artwork created. When a portrait is commissioned, I reserve the right to display it on my website and social media pages but I will not share your personal details. If you do not wish your commissioned portrait to be shown online please notify me prior to confirming the commission. Although you may gift or sell the original Artwork, you do not have the right to sell copies of the Artwork in any way without permission from me.
Reference photo
The photographs that you provide for reference images must have been taken either by you or you have permission for their use from the person who took or published them. If the Artwork is to be a gift, you accept responsibility for sourcing and using images that are of the recipient’s pet and that I have permission to use them for the Artwork. By sending me reference photos, you grant me permission to use them in my publicity and advertising media solely to show a comparison between the reference photo and the final Artwork.
Quotes
Each commission is unique so the prices on my website are only a guide. Once I understand your requirements, I will be able to give you a more accurate quote. The quote will be valid for 30 days, although if you alter some aspect of the brief or the commission changes in some way, I may update the quote. I will always let you know if any of the changes you want will have an effect on the overall cost of the commission.
Timescales
I will give an estimate of the date that I aim to start the artwork, and the date you should expect to receive it by, but these are estimates and not a guarantee. While I will work hard to meet any deadlines you may have, this is not guaranteed. I will, however, keep you up to date with any changes to the estimated time of arrival.
Payment
Before committing to completing a commission and starting work on drawing it, the payment of a non-refundable 25% deposit is required. Then, once you are happy with the finished Artwork and have paid the full amount plus postage and packaging, it will be posted to the address provided by you. You are responsible for providing an up to date address for posting of the Artwork.
Cancellations
You are under no obligation to pay the full amount until you are happy with the final Artwork. If, for any reason, you want to cancel your commission before the final payment is made, you are free to do so at any time and will not need to pay any outstanding amount. I will, however, retain both the Artwork and the deposit which is non-refundable. If you fail to pay for the finished Artwork within 30 calendar days after notification of completion, and I have not agreed to an extension of the payment terms, the commission will be deemed as cancelled and I will retain the Artwork and the deposit.
Shipping
All orders are posted securely with a tracking number to the address you provide. If the item is a gift, I will post it to the recipient’s address given to me by you.
Shipping damage
The Artwork will be packaged extremely well. In the unlikely event that damage occurs during transit please send a photograph of the damaged Artwork to me immediately. Depending on the extent of the damage, if the Artwork needs to be redrawn, it must be returned to me and a new portrait will be drawn at no cost once it is received. The new portrait will be added to the Artist’s waiting list so a timeline cannot be guaranteed.
Liability
With the exception of the Copyright section of these Terms and Conditions, the liability of each party shall be limited to the price of the commission.
